Terms of Service — Servus: Integrationsprüfung

These Terms of Service ("Terms") govern your use of Servus: Integrationsprüfung ("the app"), operated by Kelly Zwart ("we", "us").

By using the app you agree to these Terms. If you don't agree, don't use the app.

1. The product

Servus: Integrationsprüfung is a study tool designed to help you prepare for:

• the Austrian citizenship test Staatsbürgerschaftstest and the Werte- und Orientierungswissen (values and orientation knowledge) — free, multiple-choice practice modes; and
• the ÖIF-Integrationsprüfung (A2/B1, whose language core is the Deutsch-Test für Österreich, DTÖ) — a paid practice mode covering listening (Hören), reading (Lesen), writing (Schreiben) and speaking (Sprechen), with results indicated at A2 or B1 level.

It is not an official product of the Österreichischer Integrationsfonds (ÖIF), telc, the Bundesministerium für Inneres (BM.I), or any Austrian public authority, and we are not affiliated with them. Practising with our app is a study aid and is no guarantee that you will pass the real exam.

About the exam content. All content in the app is our own original work. The Staatsbürgerschaftstest and Werte practice questions are written by us, based on the publicly available official study materials (Lernunterlagen at staatsbuergerschaft.gv.at and public ÖIF information) — we do not reproduce official exam questions or ÖIF materials. All Integrationsprüfung practice material (reading and listening texts, writing and speaking tasks, audio, and model answers) imitates only the exam format and is likewise our own original work — we do not copy ÖIF, telc, or official model-test materials.

2. Account and access

• Free tier: no account needed. You can use the Staatsbürgerschaftstest and Werte practice immediately with the included free content.
• Paid tier (Integrationsprüfung): you provide an email address when you start a trial or purchase. Your entitlement is tied to that email and/or your Apple ID.
• We may verify your entitlement on each app launch. If validation fails, you may temporarily be downgraded to free until validation succeeds.

3. Payments and refunds

Integrationsprüfung access is offered as a 1-month pass, a 3-month pass, or one-time lifetime access. Indicative prices (the price shown in the app or at checkout is always authoritative and may vary by store/region): 1-month €9,99, 3-month €19,99, lifetime €49,99. These are one-time, non-renewing purchases — they do not auto-renew.

Mobile purchases (Apple, via RevenueCat)

• On iOS these are in-app purchases billed through your Apple ID; entitlements are managed via RevenueCat.
• Refunds for iOS purchases are handled by Apple. Request one at reportaproblem.apple.com.

Web purchases (via Stripe)

• Where offered, the same passes can be purchased on the web via Stripe. Prices include VAT where applicable; Stripe handles tax calculation.
• EU consumer right of withdrawal (14 days): You may request a refund within 14 days of a web purchase, but only if you have not yet used the paid content. By purchasing and immediately accessing paid content you ask us to begin performance immediately and you waive this right under EU Directive 2011/83/EU, Article 16(m). This is explicitly confirmed at checkout.
• After 14 days, no refunds. For an accidental duplicate web purchase, contact us within 7 days for a refund.

4. Trial period

A free trial (currently 7 days) is available for the Integrationsprüfung features. After the trial:

• Your access reverts to the free Staatsbürgerschaftstest/Werte tier automatically.
• No payment is taken during the trial.
• You may purchase a paid plan at any time during or after the trial.

5. Acceptable use

You agree NOT to:

• Reverse-engineer, decompile, or attempt to extract our proprietary content. All questions, explanations, Integrationsprüfung items and the software are our copyrighted work.
• Redistribute, resell, or sublicense our proprietary content.
• Use the app to harm or defraud others.
• Use the app for any unlawful purpose.

6. Intellectual property

• All practice questions and explanations are original work, written by us on the basis of publicly available official study materials.
• All Integrationsprüfung content (reading and listening texts, writing and speaking tasks, audio, and model answers) is original work, copyrighted to Kelly Zwart.
• The app's source code is proprietary.
• The app's name "Servus: Integrationsprüfung", logo, and design are ours. Exam names (Staatsbürgerschaftstest, Integrationsprüfung, DTÖ) are used descriptively to indicate which exams you can practise for.
• You receive a limited, non-transferable licence to use our content for personal study only.

7. Third-party services

The app uses:

• Apple App Store and RevenueCat for iOS distribution, in-app purchases and entitlement management.
• Stripe for web payments (where offered).
• Anthropic Claude API for AI answer grading (Integrationsprüfung Schreiben/Sprechen).
• Vercel for web/app hosting, and Upstash for entitlement/analytics storage.

Your use of these services is also governed by their terms.

8. Disclaimers

The app is provided "as is" without warranty of any kind. Specifically:

• We do not guarantee uninterrupted availability.
• We do not guarantee that practising with the app will result in passing your real Staatsbürgerschaftstest or Integrationsprüfung.
• We do not guarantee that AI grading is perfectly accurate (it is a helpful approximation, not a substitute for a qualified teacher or examiner).
• The official study materials, exam format, and pass thresholds set by the Austrian authorities and the ÖIF may change — we update the app when we learn of changes but cannot guarantee real-time synchronisation.

9. Limitation of liability

To the maximum extent permitted by applicable law:

• Our total liability for any claim is limited to the amount you paid us in the past 12 months.
• We are not liable for indirect, incidental, or consequential damages (e.g., missing your exam, lost time).
• We are not liable for exam results or residence/citizenship application outcomes.

10. Termination

• You may stop using the app at any time. Delete it from your device and any local data is wiped.
• We may terminate your access if you materially violate these Terms (e.g., reverse-engineer or redistribute our proprietary content).
• If we permanently close the service, holders of an active time-limited pass will receive a pro-rated refund for the unused period; lifetime users will receive a refund appropriate to the time since purchase.

11. Changes to these terms

We may update these Terms. Material changes will be notified in-app. Continued use after the update means you accept the new Terms.

12. Governing law and disputes

These Terms are governed by the law of the operator's country of establishment (the Netherlands). Any dispute may be brought before the competent courts there. Nothing in these Terms removes the mandatory consumer-protection rights you enjoy under EU law and the law of your country of residence — as a consumer you may also rely on the mandatory rules of, and bring proceedings in, your country of residence.
